Workers' Compensation Settlement

Workers' compensation insurer sent client who had sustained a major neck injury to an independent medical examination ("IME") with one of its preferred doctors. The doctor said the client did not need future medical care and was capable of returning to his heavy duty time-of-injury job. We reached out to the client's treating physician, who meticulously disavowed and undermined the insurer's doctor's report. The claim ultimately settled on a disputed basis for above and beyond the full value of the client's wage loss benefits plus the cost of his medical care as recommended by his treating physician.
