Client was 50 years old when he injured his low back while working in the oil fields. Initially, the workers' compensation insurer accepted his claim and paid for his back surgery. However, over the course of the next three years, the insurer continued to deny liability for any further medical treatment to the low back, claiming that the treating surgeon had released him without any restrictions. Over that time, client changed jobs to work in a lighter duty, but less lucrative, job. When it was apparent that he would need additional surgery, he hired us. We sent the client to another orthopedic surgeon for a full medical evaluation, who later opined that the client's low back problems still related back to the original workplace injury. Ultimately, we forced the insurer to cover a second surgery, pay wage loss benefits while the client recovered, and then settled his claim shortly after he reached maximum medical improvement.
