Personal Injury and Workers' Compensation Settlement

Our Client, a water truck driver working in the oil fields of Montana and North Dakota, was severely injured when he was run off the road by another semi-truck. Initially, his Workers' Compensation claim was filed in North Dakota, where benefits are less favorable compared to Montana. We were able to get his claim transferred to Montana and accepted by the Montana workers' compensation insurer, which was a significant benefit to our client because he was not required to pay back any of his worker's compensation benefits after we obtained a favorable third-party settlement against the at fault truck driver (he would have had to pay back his workers' compensation benefits if that claim had been processed under North Dakota law). When the client first contacted us, he was unaware of his right to pursue a claim against the at-fault driver, and only wanted help getting approval for medical treatment through workers' compensation. In addition to medical and wage loss benefits, we obtained favorable settlements for his Workers' Compensation claim and third-party claim against the at fault truck driver totaling $1,050,000.00.
