Our Client, who had been permanently and totally disabled for worker's compensation purposes since 1991, asked for our help in negotiating a settlement for her claim related medical benefits. This presented many complicated issues given our Client's status as a Medicare beneficiary. We were able to obtain a favorable Medicare Set Aside projection, approval by Medicare of that figure, and a significant sum of money above and beyond the Medicare set-aside amount, totaling $350,000.00, which allowed our Client to use the "to boot" settlement proceeds for medical treatments that were not otherwise covered by traditional workers' compensation and Medicare coverage.
