Client with an extensive history of back, shoulder, and neck treatment involved in a fairly low-speed motor vehicle accident. The at-fault insurer paid for the client's treatment over the first two months; however, when the client needed surgery on his shoulder, the insurer refused further payment, claiming the surgery was due to a pre-existing condition and not the motor vehicle accident. After we obtained a favorable causation opinion from the client's surgeon, we were able to not only obtain the remaining policy limits under at-fault driver's insurance policy, but nearly three-quarters of the client's underinsured motorist coverage under his own policy. Between the two insurers, we were able to recover $167,454.95 after the at-fault insurer's denial, which was more than four times our client's medical expenses.
